Terms of Service
Terms of Service
1. These terms
These Terms of Service govern your use of the iOS and Android applications published under the Zhenxu Dev brand by Hangzhou Zhenxu Technology Co., Ltd. ("we", "us"). By downloading or using one of our apps you agree to these terms. If you do not agree, please do not use the apps.
Our handling of information is described separately in our Privacy Policy, which forms part of these terms.
2. Your right to use the apps
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use our apps on devices you own or control, for your own lawful purposes.
We retain all rights in the apps themselves, including their software, interfaces, names and brand assets. This licence does not transfer any of those rights to you.
3. Your content
The content you create in our apps is yours. In the current released versions it is stored on your own device and we have no access to it.
Because that content lives on your device, you are responsible for backing it up. Uninstalling an app, clearing its storage, losing the device or resetting it may permanently destroy content we never held and cannot recover.
4. Acceptable use
When using our apps, you agree not to:
- Break any applicable law, or infringe anyone else's rights.
- Reverse engineer, decompile or attempt to derive the source code of the apps, except where that is expressly permitted by law.
- Interfere with, overload or attempt to gain unauthorised access to the apps or any related service.
- Redistribute, resell, rent or sublicense the apps.
- Remove or obscure any copyright, trademark or other proprietary notice.
5. Paid features and subscriptions
The current released versions do not include paid features. We intend to offer cloud synchronisation as a paid feature in future releases.
When paid features launch, they will be sold through Apple's App Store or Google Play. Prices, billing periods and currencies will be shown before you confirm a purchase. Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before it ends, and you can manage or cancel a subscription in your App Store or Google Play account settings.
Refunds are handled by the store that processed your purchase, under that store's policy — we cannot issue refunds for a store transaction directly. Any statutory rights you have to cancel or obtain a refund are unaffected by these terms.
6. App stores and third-party services
Your use of an app is also subject to the terms of the store you obtained it from. Where an app lets you connect a third-party service you have chosen, your use of that service is governed by that provider's own terms and privacy practices, and we are not responsible for it.
7. Availability and changes
We may update, change or discontinue an app or any of its features. We will give reasonable notice of a change that materially reduces functionality you rely on, where it is practical to do so. We do not promise that an app will be available without interruption or free of defects.
8. Disclaimer
To the extent permitted by law, our apps are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement.
9. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for loss of data or profit, arising from your use of or inability to use our apps. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.
10. Termination
You may stop using our apps at any time by uninstalling them. We may suspend or end your licence if you materially breach these terms. Sections that by their nature should survive termination — including sections 8, 9 and 11 — continue to apply.
11. Governing law
These terms are governed by the laws of the People's Republic of China, and disputes will be heard by the courts with jurisdiction over the location of Hangzhou Zhenxu Technology Co., Ltd.. If you are a consumer, this does not deprive you of the protection of the mandatory consumer law of your place of residence.
12. Changes to these terms
When these terms change we update the version number and the date shown at the top of this page. Continuing to use an app after a change takes effect means you accept the updated terms.
